We got a call from the Supervisor 15 minutes ago and informed us that Mt Gox filed a brief before the court responding to our March 11 brief. Although we have not taken a look at Mt Gox’s brief yet, we are speculating that Mt Gox denies in their brief the facts that a large amount of bitcoins were requested to be withdrawn from March 7 through 10 and the most of 750,000 bitcoins stored in Mt Gox had disappeared. Unfortunately, we cannot obtain a photocopy of Mt Gox’s brief at court since tomorrow is a national holiday. We will let you know when we get a copy. 2. In response to your questions: 1) can mtgox re-open somewhere in that timeline? or do they have to remain closed for a year? if they can re-open, under which circumstances? can we prevent it? In order to continue with the civil rehabilitation proceeding Mt Gox will have to re-open its business. There is no way it could stay closed for the next year. In order to re-open, with Mt Gox’s current credit condition, the location of the missing bitcoins would need to be clarified and the creditors would need to agree to Mark Karpeles continued management of Mt Gox. To prevent re-opening, we would have to submit information to the court and the supervisor sufficient to convince them that Karpeles’ continued management would result in a dissipation of the assets (see also responses 2 and 4 below). 2) can we assemble digital signatures through echosign to have people petition the supervisor for certain requests? I will email you the list of requests soon, please put this in a letter addressed to the supervisor. Yes, we can do this. It is possible to collect signatures from the creditors opposing Mt Gox’s re-opening and we can submit this to the court and the supervisor. 3) Do people really have less chance of getting the largets % in a group instead of alone? whats the advantage of a group? I understand that it’s better to remain alone in requesting pay back? There are almost always creditors who do not file a petition (because they are far away or because their claims are small, etc.). Not filing a petition means that their claims as creditors will not be recognized and they will not receive a part of the asset distribution. Accordingly, the more creditors that file petitions, the smaller their individual portion of the asset distribution since the assets will be divided among a greater number of claimants. On the other hand, acting as a group makes it easier to express the creditors’ opinions, with the group having an easier time influencing the rehabilitation proceeding. 4) Can we motivate the supervisor to go for bankruptcy? The court can decide to proceed with bankruptcy for Mt Gox in response to the creditors making their opposition to re-opening of Mt Gox known to the court and the supervisor. 5) is it realistic that we can tell the supervisor to hire the expert of our choice? At this point in time, we think it is too early for the supervisor to appoint an expert. The civil rehabilitation proceedings are now only in their initial stage and the supervisor is not yet actively involved. Any appointment of an expert would have to come after the supervisor has progressed further in the case. 3. We need more time to provide you with explanation to the timeline.
